Estate property reached by a private road may rely on separate documents for access and maintenance. A deeded easement can describe the right to travel while another agreement allocates grading, snow removal, drainage, insurance, and repair costs. Reviewing only one record can leave the transaction file incomplete.
Map the document set
Collect the deed, access easements, road agreement, amendments, plats, title exceptions, association records, invoices, notices, and purchase agreement. Index recording references and effective dates. If the title commitment cites an instrument not in the file, request it and record the gap.
Identify parties and parcels
Create a parcel table showing the estate parcel, road parcel, benefited parcels, burdened parcels, owners shown, and identifiers used in each instrument. Compare legal descriptions rather than relying solely on mailing addresses. Flag a parcel relationship that cannot be established from the supplied records.
Extract operational duties
Record who may use the road, what work is covered, how decisions are made, and how expenses are divided. Capture fixed percentages, frontage formulas, usage formulas, voting thresholds, notice methods, reserve contributions, and collection provisions exactly. Do not calculate a new allocation when the document is ambiguous.
Reconcile current status
Compare recent invoices, payment evidence, meeting notes, and notices with the agreement. Identify arrears, planned work, disputes, or insurance requirements disclosed in the file. A lack of invoices does not prove that no obligation exists. State the search scope and missing evidence.
Connect the contract conditions
Locate inspection, financing, title, disclosure, access, and document-delivery provisions that refer to the road. Track delivery and review deadlines separately. Confirm that the closing handoff assigns open requests for estoppel, payoff, insurance, transfer, or consent.
Legal access, enforceability, lien rights, lender requirements, and the sufficiency of disclosure require professional judgment. The document review should make the evidence and unanswered questions easy to trace.
